    Terms of Service

    The agreement between you and Beyond23 covering the website, BioAge, accounts, memberships, AI features, labs, connected devices, coaching and Sprints.

    1Agreement and scope

    These Terms of Service (“Terms”) are a binding agreement between you and TECHVITA LABS PRIVATE LIMITED (CIN: U72100GJ2024PTC150525), operating as Beyond23 (“Beyond23”, “B23”, “we”, “us” or “our”).

    The Terms govern your access to and use of beyond23.life, the BioAge screening, Beyond23 accounts, mobile and web applications, memberships, assessments, AI-supported features, laboratory coordination, connected devices, coaching, Sprints, content and any other product or service that links to these Terms (collectively, the “Services”).

    By selecting “I agree”, creating an account, purchasing a Service or continuing to use a Service after being shown these Terms, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.

    Order-specific terms, programme descriptions, consent forms, refund rules or professional-service terms presented at purchase or enrolment also apply. If they conflict with these Terms, the more specific terms govern that Service.

    2Eligibility

    You must be at least 18 years old and legally capable of entering a binding agreement to use BioAge, create a personal account or purchase a Service, unless a specific Beyond23 service expressly permits use by a minor with verifiable parent or guardian consent.

    You agree to provide accurate information, use your own identity and comply with applicable law. If you use the Services outside India, you are responsible for any local requirements that apply to you.

    3What Beyond23 provides

    Depending on availability and your plan, the Services may include:

    • educational website content and research summaries;
    • BioAge screening, archetypes and dimension-level insights;
    • a healthspan baseline based on information you provide;
    • integration and interpretation of laboratory, wearable and self-reported information;
    • AI-supported summaries, coaching and recommendations;
    • challenges, reminders, check-ins and behaviour-change tools;
    • human coaching or access to independent clinicians or professionals;
    • focused programmes or Sprints;
    • coordination with third-party laboratories, diagnostic providers, wearables or product partners; and
    • other features introduced over time.

    Features, availability, eligibility and pricing may vary by location, device, plan and partner coverage. A description is not a guarantee that a feature will always be available.

    4Health and medical disclaimer

    4.1 Wellness and educational purpose

    Unless expressly identified as a regulated professional service delivered by an appropriately licensed clinician, Beyond23 provides wellness education, organisation, pattern recognition, coaching and decision support. It does not practise medicine, diagnose disease, prescribe treatment or replace a physician-patient relationship.

    4.2 Do not rely on the Services for emergencies

    The Services are not designed for emergencies or continuous clinical monitoring. If you believe you may have a medical emergency, contact local emergency services or seek immediate in-person care. Do not wait for a Beyond23 message, coach or AI response.

    4.3 Do not change treatment solely because of Beyond23

    Do not start, stop or change a medicine, supplement, test, diet or treatment solely on the basis of a BioAge result, AI output, wearable signal, article or coach message. Discuss decisions with an appropriately qualified professional, particularly if you are pregnant, have a medical condition, use prescription medication or experience new or worsening symptoms.

    4.4 Limitations of health data

    Laboratory values may vary by collection conditions, method and reference range. Wearables and home measurements may be incomplete or inaccurate. User-entered information may contain errors. Correlation does not establish causation, and a normal result does not exclude disease.

    4.5 Professional services

    If a licensed clinician provides a consultation through or in connection with Beyond23, the clinician is responsible for their professional judgment and will provide any required professional disclosures and consent. Beyond23 may provide technology, administration or coordination without controlling independent clinical judgment.

    5BioAge-specific terms

    BioAge is a brief screening designed to encourage reflection across healthspan-related dimensions. You acknowledge that the result depends on the answers you provide and may change when information changes, and that the output is a screening range, archetype or educational indication, not a diagnosis. In particular:

    • BioAge is not a validated measurement of lifespan, biological age, disease risk, fitness for treatment or insurability unless a specific feature clearly states its validation and intended use;
    • the result should not be used for employment, insurance, credit, legal capacity or another high-stakes decision;
    • the screening cannot identify every risk or condition; and
    • no outcome, improvement or extension of life is promised.

    The more comprehensive Beyond23 assessment may add labs, wearables, history and professional input. It remains subject to the limitations of its underlying data and is not a substitute for clinical care.

    6Accounts, OTPs and security

    You may need an account, verified mobile number, email or OTP to use certain Services. You agree to:

    • maintain accurate account information;
    • keep devices, OTPs, passwords and access links secure;
    • not share or sell account access;
    • notify us promptly at security@beyond23.life of suspected unauthorised access; and
    • accept responsibility for activity reasonably attributable to your account until you notify us.

    Beyond23 will never ask you to disclose a banking PIN, card PIN, CVV or full OTP to an employee, coach or partner.

    7Information and content you provide

    You retain ownership of personal information, health records, photographs, voice recordings, messages and other content you submit (“User Content”).

    You grant Beyond23 a limited, non-exclusive licence to host, copy, process, format, analyse and transmit User Content only as reasonably necessary to:

    • provide and secure the Services;
    • make displays or reports available to you;
    • coordinate a service you request;
    • comply with law; and
    • improve the Services using de-identified or aggregated information, or identifiable information where you have separately consented.

    You represent that you have the right to provide User Content and that it is accurate to the best of your knowledge. Do not upload unlawful, infringing, malicious or unauthorised content or another person’s health information without lawful authority.

    8AI-supported features

    AI outputs are probabilistic and may contain errors, omissions or outdated information. You should review the underlying facts and seek professional advice where appropriate.

    You must not use an AI-supported feature:

    • as the sole basis for emergency, diagnostic, treatment or medication decisions;
    • to obtain instructions for self-harm, unlawful conduct or evading professional care;
    • to make high-stakes decisions about another person;
    • to impersonate a professional or misrepresent an output as professional advice; or
    • to submit information you are not authorised to share.

    Beyond23 may apply safety limits, decline to answer, recommend professional review or route an interaction to a human. Human review does not make every output medically complete or error-free.

    9Connected devices, apps and imported records

    If you connect a third-party device, health platform or account, you authorise Beyond23 to access the categories you select. You are responsible for reviewing the permissions and the third party’s terms.

    Beyond23 does not manufacture or control third-party devices and is not responsible for their accuracy, availability, battery, firmware, cybersecurity or independent processing. We may normalise, display or interpret imported information but cannot guarantee that every data point is received or mapped correctly.

    You can disconnect an integration, although some Service functions may stop and previously imported data may remain in accordance with the Privacy Policy.

    10Laboratories, diagnostics, products and other partners

    Beyond23 may coordinate services supplied by third parties, including sample collection, laboratory testing, diagnostics, wearables, supplements, products or professional support.

    The applicable order page will identify whether Beyond23 is the seller, facilitator or programme coordinator. Third-party providers remain responsible for services they independently perform, including collection procedures, laboratory methods, reports, professional conduct, delivery and product quality.

    You agree to follow preparation and safety instructions and to provide accurate booking information. Delays, rejected samples, recollection, reference ranges and report formats may depend on the provider.

    If a report appears inconsistent with your condition or you have urgent symptoms, contact an appropriate clinician rather than relying only on the platform.

    Nothing in these Terms excludes responsibility that cannot lawfully be excluded, including applicable consumer rights.

    11Coaching and Sprints

    Coaches may support goal-setting, education, adherence, reflection and behaviour change. Unless separately identified as a licensed clinician providing a professional service, a coach does not diagnose, prescribe or replace medical care.

    You remain responsible for deciding whether an activity is appropriate and for informing the coach of relevant limitations. Stop an activity and seek medical advice if you experience concerning symptoms.

    Sprint content, duration, included tests, sessions, response times and follow-up measures will be described at purchase. Missed sessions, rescheduling and programme pauses are governed by the order-specific policy.

    12Prices, subscriptions and payment

    Prices, taxes, inclusions and billing periods will be displayed before purchase. Unless stated otherwise, prices are in Indian rupees.

    12.1 Founding Club reservations and phased invitations

    Joining the Founding Club, waitlist or reservation list records your interest; it is not a completed purchase, does not guarantee admission on a particular date and does not require payment at the reservation stage.

    Beyond23 currently plans to begin inviting founding members in batches during August or September 2026, subject to product readiness, partner availability, location and capacity. This is an indicative launch window, not a guaranteed release date.

    If you are invited, the team will contact you to confirm eligibility, location, scheduling, programme inclusions, current price and any preparation requirements. Payment will be requested only after this outreach and before the relevant appointment, laboratory booking or programme activation. You may decline the invitation without charge.

    Before collecting payment, Beyond23 will display or send the applicable order terms, including the final price, inclusions, expected schedule, cancellation and refund terms and any third-party service conditions. A place is confirmed only after any required verification and successful payment.

    12.2 Future subscriptions

    If a subscription automatically renews:

    • we will disclose the recurring amount and interval before you authorise payment;
    • renewal will occur through the mandate or payment method you approve;
    • you may cancel future renewal through your account settings or by contacting billing@beyond23.life; and
    • cancellation stops the next renewal but does not ordinarily reverse a period already supplied.

    We may change future pricing or plan features with reasonable advance notice. A price change will not be applied retroactively to a completed purchase.

    Payments may be processed by a third-party provider. You authorise the provider and Beyond23 to process transaction information needed to complete and manage the purchase.

    13Cancellations, rescheduling and refunds

    No refund is required for a Founding Club reservation because no payment is collected at that stage. When paid bookings and memberships become available, the cancellation and refund terms shown before payment will form part of the applicable order.

    Those terms will distinguish:

    • digital memberships not yet activated;
    • partially used subscription periods;
    • laboratory bookings before and after a collection slot or kit has been dispatched;
    • failed or rejected samples and recollection;
    • coaching sessions cancelled within or outside the notice period;
    • Sprints before and after onboarding or materials have been delivered; and
    • defective physical products.

    Refunds, where approved, will ordinarily be returned to the original payment method within the timeframe displayed. Nothing in the refund policy limits non-excludable rights under applicable consumer law.

    14Communications

    You agree to receive communications reasonably necessary to verify and administer the Services, including OTPs, security notices, purchase confirmations, appointment updates, programme messages and material policy changes.

    Marketing by email, SMS, WhatsApp or push notification is subject to your preferences and applicable law. You can opt out of marketing, but not essential service communications.

    15Acceptable use

    You must not:

    • use the Services unlawfully or to harm another person;
    • access another person’s account or submit their health information without authority;
    • attempt to bypass security, probe vulnerabilities, introduce malware or disrupt the Services;
    • scrape, harvest or use automated means to extract data except with written permission;
    • reverse engineer, decompile or copy the Services except where law expressly permits;
    • reproduce, sell or commercially exploit content or outputs except as authorised;
    • misrepresent your identity, qualifications or affiliation;
    • use the Services to train or benchmark a competing model or product without written permission;
    • remove proprietary notices;
    • harass coaches, clinicians, staff, partners or users; or
    • use outputs for discriminatory, insurance, employment or other high-stakes decisions about another person.

    We may investigate misuse and restrict or suspend access where reasonably necessary to protect users, partners or the Services.

    16Beyond23 content and intellectual property

    Beyond23 and its licensors own the Services and related software, designs, branding, research summaries, selection and arrangement of content, scoring logic, models and other intellectual property, excluding User Content and third-party materials.

    We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your own lawful, non-commercial wellness purposes during the applicable term.

    No right is granted to use Beyond23 names, marks, interfaces, datasets or content for commercial purposes without written permission.

    17Feedback

    If you provide suggestions or feedback, you permit us to use them without restriction or payment, provided we do not publicly identify you without permission. This does not transfer ownership of your personal health data or User Content.

    19Service availability and changes

    We aim to provide reliable Services but do not guarantee uninterrupted availability. Maintenance, partner outages, device compatibility, internet failures, security events or legal requirements may affect access.

    We may add, modify, suspend or discontinue a feature. If a material change adversely affects a prepaid core Service, we will provide an appropriate remedy required by the order terms or applicable law.

    Beta, pilot or early-access features may be less reliable and may change more frequently. They will be labelled where practical.

    20Disclaimer of warranties

    To the maximum extent permitted by law, the Services are provided on an “as available” basis. Beyond23 does not promise that every insight will be accurate, complete, current or suitable for every person, or that use will achieve a particular health, weight, biomarker, biological-age or longevity outcome.

    Nothing in these Terms excludes an express written commitment made in an applicable order or rights and warranties that cannot lawfully be excluded.

    21Limitation of liability

    To the maximum extent permitted by law, Beyond23 will not be liable for indirect, incidental, special, punitive or consequential loss, or loss of profits, opportunity or data, arising from use of the Services.

    For claims that may lawfully be limited, Beyond23’s aggregate liability arising from the relevant paid Service will not exceed the amount you paid to Beyond23 for that Service during the 12 months preceding the event giving rise to the claim.

    The limitations do not apply to liability that cannot lawfully be limited or excluded, including fraud, wilful misconduct, or any other liability protected by applicable consumer or other law.

    22Your responsibility for misuse

    To the extent permitted by law, you are responsible for reasonably foreseeable losses arising from your unlawful use of the Services, infringement of another person’s rights, unauthorised submission of another person’s data or material breach of these Terms. This clause does not require a consumer to indemnify Beyond23 for Beyond23’s own negligence, misconduct or legal obligations.

    23Suspension and termination

    You may stop using the Services and request account closure at any time, subject to outstanding purchases, professional record obligations and the Privacy Policy.

    We may suspend or terminate access where reasonably necessary because of:

    • serious or repeated violation of these Terms;
    • fraud, abuse, security risk or unlawful conduct;
    • non-payment;
    • harm or harassment;
    • a legal or regulatory requirement; or
    • discontinuation of a Service.

    Where appropriate, we will give notice and an opportunity to resolve the issue. After termination, provisions concerning intellectual property, payment obligations, disclaimers, liability, disputes and other terms intended to survive will continue.

    24Changes to these Terms

    We may update these Terms as the Services or law changes. We will provide reasonable notice of a material change. A change will not retroactively alter a completed purchase unless required by law or agreed by you.

    If you continue to use the affected Service after revised Terms take effect, you accept the revised Terms. If you do not agree, you should stop using the Service and cancel future renewal.

    25Governing law and dispute resolution

    These Terms are governed by the laws of India.

    Before filing a claim, please contact legal@beyond23.life so the parties can attempt to resolve the dispute in good faith.

    Subject to rights and forums that cannot lawfully be excluded, the courts at Ahmedabad, Gujarat will have jurisdiction.

    Nothing in this section limits a consumer’s right to seek relief under the Consumer Protection Act, 2019 or another applicable law.

    26General provisions

    • Entire agreement. These Terms, the Privacy Policy and applicable order-specific terms form the agreement concerning the Services.
    • Severability. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue.
    • No waiver. Failure to enforce a provision is not a waiver.
    • Assignment. You may not transfer your account or these Terms without our consent. We may assign the agreement as part of a reorganisation, financing or transfer of the business, subject to applicable law.
    • Force majeure. Neither party is responsible for delay caused by events beyond reasonable control, except for payment obligations already due and rights that cannot be excluded.
    • Electronic communications. You consent to receive agreements, notices and records electronically where permitted.
    • Headings. Headings are for convenience and do not affect interpretation.
    • Language. Where a translated version is provided, the English version controls, subject to applicable law.
